1. STANDARD TERMS
1.1 Information on "how to enter" and details of prizes form part of conditions of entry.
1.2 If you enter the Girlfriend Model Search competition 2007 (BI), you are deemed to have accepted all of the conditions of entry.
1.3 The Promoter is Pacific Magazines Pty Ltd, 35-51 Mitchell Street, McMahons Point, NSW 2060 (ABN 16 097 410 896) (Pacific).
2. WHO CAN ENTER
2.1 You can enter the Competition if you are an Australian resident over 12 years of age. Proof of age and residency may be required before collecting prize - this proof must be in the form of legally issued documentation and Pacific reserves the right to require further proof for any reason.
2.2 You cannot enter the Competition if you or any close family member works for Pacific or any company associated with the Competition.
2.3 You cannot enter the Competition if you are currently represented by a modelling agency or have ever performed in any professional modelling capacity OR if you sign a contract with a modelling agency or start to perform in any professional modelling capacity during the Competition.
2.4 Entrants under the age of 18 must obtain the prior permission of a parent or guardian over the age of 18 to enter. Your parent or guardian must sign the form and Pacific may call them to check that they have granted permission for you to do this.
3. CONDITIONS OF ENTRY
3.1 You can only enter once.
3.2 You can only enter the Competition by:
a) filling in the the entry form that you will find in May 2007 and June 2007 issues of Girlfriend magazine and mailing it to Pacific at GF Model Search 2007 PO Box 129 Eastern Suburbs MC NSW 2004;
b) filling in the entry form that you can download from www.girlfriend.com.au and mailing it to Pacific at GF Model Search 2007 PO Box 129 Eastern Suburbs MC NSW 2004; or
c) filling in a form in person at one of the Girlfriend Model Search 2007 road-shows (Roadshows) and handing it to a member of Pacific's staff on that day.
3.3 If you enter by mail, whether using the form from the magazine or from the website, you must use an original form (not a copy) and you must enclose ONE clear photograph of yourself no larger than A4 size. You must own the copyright in that photograph.
3.4 If you enter at one of the Roadshows, you must fill in an entry form and your photograph will be taken by a member of Pacific's staff. Your photograph will be taken only ONCE unless there is a fault - please do not ask for more than one photograph to be taken.
3.5 Your entry form and your photograph become the property of Pacific. They will not be returned.
4. HOW TO ENTER BY MAIL
4.1 If you are mailing your entry and photograph:
a) entries will be accepted from 9am EST on 4 April 2007
b) entries close at 5pm EST sharp on 1 June 2007.
MAIL ENTRIES WILL NOT BE ACCEPTED AFTER THIS TIME FOR ANYONE FOR ANY REASON.
5. HOW TO ENTER THROUGH THE ROADSHOWS
5.1 After 5pm EST sharp on 1 June 2007, you can only enter the Competition by going to one of the five Roadshows scheduled as follows:
a) In Adelaide on 16 June 2007 at Westfield Marion;
b) In Brisbane on 23 June 2007 at Westfield Carindale;
c) In Melbourne one 30 June at Westfield Southland;
d) In Perth on 7 July at Westfield Carousel; and
e) In Sydney on 14 July at Westfield Parramatta.
6. WHAT HAPPENS AT THE ROADSHOWS
6.1 The judges will have selected a number of entrants from the mail entries to attend the Roadshow that is closest to their home (Mail Choices).
6.2 If you are one of the Mail Choices, Pacific will phone you by 4 June 2007. Please do not contact Pacific.
6.3 If you are one of the Mail Choices and live in a regional location which means that you will have to travel a significant distance to attend the closest Roadshow, Pacific may, in its complete discretion, arrange and pay for transport for you and ONE guardian to attend the Roadshow. Please note that Pacific decides who is entitled to this assistance, Pacific decides what a ‘significant distance' is and Pacific decides the mode of transport that will be offered.
6.4 At the Roadshow, the Mail Choices will meet the judges from Girlfriend magazine and CHIC Model Management (Judges).
6.5 If you enter at a Roadshow, you may be asked to meet the Judges (Roadshow Choices).
6.6 On the day of the Roadshow, the Judges will be deciding who will be selected to be one of the six state finalists (State Finalists). State Finalists can be selected from the Mail Choices or the Roadshow Choices. If you are one of the State Finalists, Pacific will notify you in person on the day of the Roadshow and you will receive confirmation by mail by 28 July 2007.
7. THE SCHWARZKOPF HAIR COMPETITION
7.1 In addition, there will be a Schwarzkopf hair competition (Hair Competition).
7.2 At each Roadshow, a representative from Schwarzkopf will select at least 5 hair finalists whose hair fulfils the pre-determined criteria. From this group of 30 state finalists, 5 national finalists will then be selected and then our major winner will then be selected. There will be only one major Hair winner across Australia.
7.3 Please note that the Hair Competition is based on skill; chance plays no part in selecting the winner. The Hair Winner/s will be judged based on the look of their hair on the day, as well as their individual style and appearance.
7.4 5 state finalists will be selected from each state:
a) In Adelaide on 16 June 2007 at Westfield Marion;
b) In Brisbane on 23 June 2007 at Westfield Carindale;
c) In Melbourne on 30 June at Westfield Southland;
d) In Perth on 7 July at Westfield Carousel; and
e) In Sydney on 14 July at Westfield Parramatta.
7.5 From this group, our major winner will be selected and notified by mail by 28 July 2007.
7.6 If you are one of the Hair Winner/s, you MUST be able to be in Sydney on a particular date (yet to be confirmed and decided at the complete discretion of Pacific) for a photographic shoot for a Schwarzkopf advertisement (Hair Shoot). If you cannot attend on the date selected, you will be disqualified and the Judges may, in their complete discretion, select another Hair Winner/s.
7.7 Pacific will arrange and pay for one return economy airfare (valued up to $600 each) and one night in 4 star twin share accommodation (valued up to $200 per room) for the National Hair Winner/s.
7.8 The Hair Winner/s will be featured in a Schwarzkopf advertisement which will be published in the November issue of Girlfriend magazine
7.9 The Hair Winner/s will each receive a Schwarzkopf prize pack valued at up to $200 each.
7.10 The Hair Competition is separate to the Competition. Hair Winner/s will not be eligible for any prizes associated with the Competition. However, all conditions of entry applying to the Competition also apply to the Hair Competition.
8. WHAT HAPPENS AT THE STATE FINALS
8.1 After the Roadshow, the Judges will meet and will select 6 of the State Finalists, who will be asked to proceed to the national finals (National Finalists).
8.2 If you are one of the National Finalists, Pacific will notify you by phone by 17 July 2007. Your name and photo will also be published in November 2007 issue of Girlfriend magazine and online at www.girlfriend.com.au.
8.3 Please note that the Competition is based on skill; chance plays no part in selecting the winner. The State Finalists and National Finalists will be judged based on individual style and appearance.
9. WHAT HAPPENS AT THE NATIONAL FINALS
9.1 If you are one of the National Finalists, you MUST be able to be in Sydney on 20 July 2007 and 21 July 2007 for a photographic shoot and publicity (Final Shoot). If you cannot attend on these dates, you will be disqualified and the Judges will select another National Finalist.
9.2 If you are one of the National Finalists you must, by 19 July 2007, provide Pacific with a consent form signed by you AND if you are under 18, your parent or guardian. If you do not or cannot provide this release, you will be disqualified and the Judges will select another National Finalist.
9.3 A representative from Pacific will chaperone all minors for the time that they are in Sydney for the Final Shoot.
10. FINDING THE WINNER
10.1 The Judges will select the Girlfriend Model Search 2007 winner (Winner) on 1 August 2007 based on their overall performance at the Final Shoot and their overall appearance.
10.2 The Winner will be announced at the event to announce the Winner (Event) held in Sydney on Friday 23 November 2007. The name and photo of the Winner will also be published in January 2008 issue of Girlfriend magazine and online at www.girlfriend.com.au.
10.3 All National Finalists are also required to be available on this date to attend the Event.
11. PRIZES FOR STATE FINALISTS
Each State Finalist will receive the following -
12 month subscription to Girlfriend magazine 30 @ $50 each = $1500 total
Schwarzkopf prize pack 30 @ up to $200 each = $6000
Photo published on Girlfriend's website Not able to be valued
12. PRIZES FOR NATIONAL FINALISTS
12.1 Each National Finalist will receive the following -
A representation contract (on standard terms) with CHIC Model Management for 24 months Not able to be valued
Hair and makeup for the Final Shoot 6 @ up to $150 each = $900 total
If interstate, one return economy airfare from nearest capital city to Sydney on 20 July 2007, returning on 21 July 2007, for Final Shoot 6 @ up to $600 each = up to $3600 total, depending on number and distance
One night in 4 star accommodation (one three bedroom suite) on 20 July 2007 for Final Shoot 1 room valued up to $600 total (shared accommodation)
Transfers and all meals whilst in Sydney for Final Shoot 6 @ up to $150 each = up to $900 total
A photographic shoot in Sydney which will result in an appearance in the November issue of Girlfriend magazine Valued up to $5000
If interstate, one return economy airfare from nearest capital city to Sydney on 23 November 2007 for Announcement Event 6 @ up to $600 each = up to $3600 total, depending on number and distance
One night in 4 star accommodation (one three bedroom suite) on 23 November 2007 for Event 1 room valued up to $600 total (shared accommodation)
Transfers and all meals whilst in Sydney for Event 6 @ up to $150 each = up to $900 total
Hair and makeup for Event 6 @ $100 each = $600
13. PRIZES FOR THE WINNER
13.1 The Winner will receive the following -
An additional representation contract (on standard terms) with Next Agency in New York Not able to be valued
A photographic shoot for 2 fashion features to appear in Girlfriend magazine to be published at editorial discretion
valued up to $5000
14. TOTAL PRIZE POOL VALUE
14.1 The total overall prize pool valued up to $29,200 as at 06/03/07.
14.2 Prize values are based upon the recommended retail prices at the time of printing (inclusive of GST). Pacific accepts no responsibility for change in prize value between now and the ultimate prize redemption date.
14.3 Prizes are not exchangeable, transferable or redeemable for cash.
14.4 All other costs relating to the entering and competing in the Competition are the finalists' responsibility. Anyone that wishes to travel with you must do so at their own cost.
14.5 You are advised that tax implications may arise if you win any prizes and you may need to seek independent financial advice prior to acceptance of that prize.
15. IMPORTANT CONDITIONS REGARDING PRIZES
15.1 If you enter the Competition, you agree that, if you become one of the National Finalists, you MUST sign a representational contract with CHIC Model Management. That contract will be in place for 24 months and you cannot accept work for any other agency during that time.
15.2 If you become a National Finalist and do not sign the representational contract with CHIC Model Management, you are not able to continue in the competition. You will be disqualified and the Judges will select a replacement National Finalist. You will not be entitled to any prizes and must return the prizes that have been delivered to you.
15.3 If you enter the Competition, you agree that, if you become the Winner, you MUST sign a representational contract with Next Agency in New York. That contract will be in place for 24 months and you cannot accept work for any other agency during that time.
15.4 If you become the Winner and do not sign the representational contract with Next Agency in New York, you will be disqualified and the Judges will select a replacement Winner. You will not be entitled to any prizes and must return the prizes that have been delivered to you. In addition, CHIC Model Management has the right to terminate any agreement it may have signed with you as a National Finalist.
16. DISQUALIFICATION
16.1 Pacific reserves the right to verify the validity of entries.
16.2 In addition to the right to disqualify set out in any other clauses, Pacific can disqualify an entrant if:
a) their entry includes materials that Pacific considers to be objectionable or defamatory;
b) they tamper with the entry process or enter more than once;
c) they submit an entry that does not comply with these conditions;
d) they work for (or have a family member that works for) Pacific or any companies associated with the Competition;
e) they are or become represented by a modelling agency or have performed in any professional modelling capacity or start to perform in any professional modelling capacity during the Competition;
f) they (or their parent or guardian) does not sign any form that may be required by Pacific from time to time, including without limitation the form required under clause 8.2;
g) they (or their parent or guardian) withdraws their consent to that person being in the Competition;
h) Pacific has reason to believe that person has breached any of these conditions;
i) they have, in the opinion of Pacific, engaged in conduct in entering the Competition which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Pacific;
j) the person is engaged in any unlawful or other improper misconduct
k) the person is engaged in any misconduct calculated to calculated to jeopardise the fair and proper conduct of the Competition; or
l) for any other reasonable grounds.
16.3 Pacific reserves the right to recover damages or other compensation from anyone who is disqualified.
16.4 Clause 15.2 applies even if you are selected as a State Finalist, a National Finalist or the Winner. If you are disqualified, you must return all prizes to Pacific. Chic Modelling Agency and/or Next Agency have the right to terminate any agreement either may have signed with you.
17. NO LIABILITY
17.1 In the case of the intervention of any outside act, agent or event which prevents or significantly hinders our ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, Pacific may in its absolute discretion cancel the competition and recommence it from the start on the same conditions.
17.2 Pacific, the prize suppliers and sponsors and their associated agencies and companies will take no responsibility for prizes damaged or lost in transit, or late, lost or misdirected mail.
17.3 Pacific, the prize suppliers and sponsors and their associated agencies and companies will not be liable for any misadventure, accident, injury, loss (including but not limited to consequential loss) or claim that may occur:
a) during the judging;
b) whilst undertaking any travel won on or connected with their entry into the Competition; or
c) in the participation in any prize;
d) as a consequence of late, lost or misdirected mail;
e) due to the publication of any material or the broadcast of any material relating to the competition, including any statements made by any staff member, journalist, other entrants or any other person.
17.4 Pacific reserves the right to refuse to allow any prize winner to take part in any or all aspects of the prize, if Pacific determines, in their absolute discretion, that the prize winner is not in the mental or physical condition necessary to be able to participate in the prize.
17.5 Pacific reserves the right to reasonably amend or vary these terms and conditions at its sole discretion, orally or in writing.
17.6 The Judges' decision in relation to any aspect of the Competition is final and binding on each person who enters.
17.7 Chance plays no part in determining the winner. Pacific and the Judges will NOT enter into correspondence with anyone about the result of the Competition.
18. COPYRIGHT
18.1 All entrants, including the State Finalist, the National Finalists and the Winner, agree to grant Pacific a perpetual and non-exclusive licence to use all photographs taken of them during the Competition and all other material created for the purposes of the Competition in all media worldwide. You agree that Pacific is able to do this without asking your permission and you are not entitled to receive any money for such use by Pacific.
19. PRIVACY
19.1 Pacific is collecting the entrant's personal information for the purpose of conducting and promoting this competition (including but not limited to determining and notifying winners). The entrant may request access to his or her personal information by writing to Privacy Officer, c/- Legal Department, Seven Network Limited, PO Box 777, Pyrmont NSW 2009.
